This passed on November 3rd, 2009 with 71.56% of the votes going to "Yes".

Below is the issue as it will appear on the ballot.  We are asking readers to review the issue as it is written and vote accordingly.  This is going to be one of the hotest topics for Chillicothe's Novermber 3rd election.   

An ordinance restricting the use of mobile speed enforcement vehicles and traffic law
photo-monitoring devices and repealing ordinance number
151-07 and chapter 315 of the revised ordinances of chillicothe, ohio
(Proposed by Initiative Petition)
To enact an ordinance preventing the City of Chillicothe from using mobile speed
enforcement vehicles and traffic law photo-monitoring devices in the City of Chillicothe.
This proposed law would:
1. Prevent the city of Chillicothe, including its various boards, agencies and
departments from using photo-monitoring devices or mobile speed enforcement vehicles
for the enforcement of a “qualified traffic law violation,” unless a law enforcement
officer is present at the location of the device or vehicle and personally issues the ticket to
the alleged violator at the time and location of the violation.
2. Repeal Chillicothe ordinance number 151-07 and Chapter 315 of the Revised
Ordinances of Chillicothe, Ohio, and prevent the City from enacting or enforcing any
ordinance that conflicts with this proposal.
3. Prevent the City from contracting with a vendor for the installation of any traffic
law photo-monitoring device or mobile speed enforcement vehicle if payment to the
vendor is contingent on the number of tickets issued or fees collected.
4. Allow the violator of any traffic law violation, in any civil proceeding, to be
entitled to the benefits of the Ohio Rules of Civil Procedure, the Ohio Rules of Evidence
and Title 23 of the Ohio Revised Code.
5. Allow the violator of any traffic law violation, in any administrative proceeding,
to be entitled to the benefits of Title 119 of the Ohio Revised Code and the Ohio Rules of
Evidence
