Council Chambers
Regular Meeting
December 22, 2008
7:30 p.m.

 

 

 

Council met in regular session with all nine members present:  Ames, Bonner, Cross, Henderson, Lester, Malone, Patrick, Proehl and Trutschel.  There were 3 media representatives and 18 other visitors present, in addition to Mayor Sulzer, City Law Director Eddy, and City Auditor Morrissey.  The meeting was broadcast live by Time Warner Cable and by Horizonview.

 

The invocation was given by Rev. Chuck Ramsey, Chaplain, Adena Regional Medical Center, followed by the Pledge of Allegiance to the Flag.

 

Mrs. Lester moved and Mrs. Malone seconded that the Minutes of the Public Hearing of December 8, 2008, the Minutes of the regular meeting of December 8, 2008, and the Minutes of the Review Session of December 15, 2008, be accepted and approved, as submitted by the Clerk.  All members present voted “yea” and Pres. Shoultz declared the motion adopted.

 

 

COMMITTEE REPORTS


Engineering Committee:

Mrs. Malone reported on Item #1 to enact Section 301.53 of the Codified Ordinances entitled “Street Lawn Area”, on tonight’s Agenda for its second reading.  Mrs. Malone reported on Item #3 to consent to the ODOT upgrade of traffic signals and to install overhead lane controls on Western Avenue, on tonight’s Agenda for its first reading. 

 

Human Resources Committee:

Mr. Bonner reported on Item #2 to amend Section 4 of Ord. No. 136-08, on tonight’s Agenda for its second reading.  He indicated that he will seek to pass this item tonight. 

 

Finance Committee:

Mrs. Henderson reported on Item #4 to make appropriation for current expenses and other expenditures for 2009, on tonight’s Agenda for its first reading.  Mrs. Henderson moved and Mr. Proehl seconded that Item #4 not be read tonight.  All members present voted “yea” and Pres. Shoultz declared the motion adopted.  Mrs. Henderson indicated that there will be a special meeting on December 29, 2008, to consider the appropriations ordinance.  Mrs. Henderson moved and Mrs. Ames seconded that the three day receipt rule be suspended, and that there be added to tonight’s Agenda an ordinance appropriating $1,796,151.79 for the purpose of continuing the handling of brought forward purchase orders from the year 2008, to be put on the books of the City of Chillicothe, Ohio to be spent during the year ending December 31, 2009, and declaring an emergency.  All members present voted “yea” and Pres. Shoultz declared the rule suspended, designating this particular item as Item #5 on tonight’s Agenda for its first reading. 

 

REPORTS OF OFFICIALS

Report of Mayor Sulzer:

Mayor Sulzer commented on Item #3, indicating that this project will be funded 100% by ODOT.  He also announced that Chief Keener today submitted his letter of resignation, effective January 6, 2009.  Mayor Sulzer wished everyone a merry Christmas. 

 

Report of Auditor Morrissey:

City Auditor Morrissey commented on Item #5, indicating that this is a typical ordinance that is passed at the end of each year.  He said that the final draft of the appropriations ordinance should be finished by tomorrow.  He wished everyone a merry Christmas.

 

Report of Law Director Eddy:

Mrs. Eddy wished everyone a merry Christmas and a happy new year. 

 

 

AUDIENCE PARTICIPATION

Dave Costilow of 17 Oakwood Drive
spoke in favor of the red light cameras.  He said that he feels that traffic is much safer on Western Avenue, and that there are others in the community who support these cameras.  He said that he asked Council not to raise his taxes, and that there should be a priority list on how to use the money generated. 

 

David May of 2359 Trego Creek Road
spoke in favor of the red light cameras.  He said that these do prevent traffic tie ups from accidents at the intersections. 

 

Tom Summers of 6110 Marietta Road
said that he is not in favor of the red light cameras.  He said that he prefers to see more patrols by police officers. 

 

Stan Mitchell of 323 Plyley’s Lane
spoke in favor of the red light cameras.  He said that he has been a volunteer firefighter and an EMT, and that he has treated many victims of traffic accidents, many of those at intersections.  He said that this is a safety issue, although he suggested reducing the fine to $50.00.  Also, he said that the city needs to provide some grace times, such as in December. 

 

Rebekah Valentich of 692 Buckeye Street
again spoke against the red light cameras, saying that she is a member of CAPE, and that Judge Martin has now ordered  cessation of red light camera enforcement.

 

Steve Richter of 343 E. Water Street
again spoke against the red light cameras, saying that he is also a member of CAPE.  He told the story about one person who mistakenly paid only $94.00 on a notice, and that this person got a second notice of the possibility of a civil action and notice to credit agencies.  He then told another story about John Paul Jones, saying that he also “has not yet begun to fight”.


OLD BUSINESS

Mrs. Malone said that there was an article in the Chillicothe Gazette on December 17, 2008, about a severe accident that occurred at the intersection of St. Rt. 32 and St. Rt. 104 where a red light was run by a tractor-trailer.  She said that the red light cameras are there for safety reasons. 

 

 

COUNCIL ASSIGNMENTS AND CALENDAR

Pres. Shoultz announced the following additional Council Committee Assignments for inclusion in the Journal of Council:

Finance-Appropriate $6,000.00 for streetlights

Development-Authorize Mayor to enter into economic development revolving loan fund agreement with state

Finance-Appropriate $15,000.00 for project administration work on new transit facility

City Services-Authorize Safety-Service Director to advertise and enter into contract for annual supplies and maintenance and repair of city equipment.

 

Pres. Shoultz indicated that there will be a special meeting on December 29, 2008, here in Council Chambers at 6:30 p.m., to consider the annual budget.

 

 

READING AND PASSAGE OF LEGISLATION

An Ordinance enacting Section 301.53 entitled “Street Lawn Area” of the Codified Ordinances of the City of Chillicothe, Ohio was read for the second time by title only. 

 

Ord. No. 163-08
amending Section 4 of Ord. No. 136-08, and declaring an emergency was read for the second time by title only.  Mr. Bonner moved and Mr. Trutschel seconded that the three reading rule be suspended, placing this item on final passage.  All members present voted “yea” and Pres. Shoultz declared the rule suspended.  All members present then voted “yea” on the item itself, and Pres. Shoultz declared Ord. No. 163-08 adopted by a vote of 9-0.

 

An Ordinance consenting to the proposal submitted by the Ohio Department of Transportation to upgrade certain traffic signals and to install overhead lane control signs on U.S. 50 west (A.K.A. Western Avenue) within the corporation limit, authorizing the Mayor to enter into contracts to complete said project, and declaring an emergency was read for the first time by title only.

 

An Ordinance appropriating $1,796.151.79 for the purpose of continuing the handling of brought forward purchase orders from the year 2008, to be put on the books of the City of Chillicothe, Ohio to be spent during the year ending December 31, 2009, and declaring an emergency was read for the first time by title only. 

 

Mrs. Malone moved and Mrs. Patrick seconded that the meeting be adjourned.  All members present voted “yea” and Pres. Shoultz declared the motion adopted.  Adjourned at 8:08 p.m.
