Council Chambers
Regular Meeting
January 12, 2009
7:30 p.m. 

 
Council met in regular session with all nine members present:  Ames, Bonner, Cross, Henderson, Lester, Malone, Patrick, Proehl and Trutschel.  There were 3 media representatives and 22 other visitors present, in addition to Mayor Sulzer, City Law Director Eddy, and Chief Deputy Auditor Donna Taylor.
 
The invocation was given by Rev. Greg Pennington, First Church of God, followed by the Pledge of Allegiance to the Flag.
 
Mrs. Henderson moved and Mr. Cross seconded that the Minutes of the regular meeting of December 22, 2008;  the Minutes of the Special Meeting of December 29, 2008;  and the Minutes of the Special Meeting of January 5, 2009, be accepted and approved, as submitted by the Clerk.  All members present voted “yea” and Pres. Shoultz declared the motion adopted.
 

COMMITTEE REPORTS

 
Engineering Committee:
Mrs. Malone reported on Item #1 to enact Section 301.53 entitled “Street Lawn Area” of the Codified Ordinances, on tonight’s Agenda for its third reading.  Mrs. Malone reported on Item #2 to consent to the ODOT upgrade of traffic signals and to install overhead lane controls on Western Avenue, on tonight’s Agenda for its second reading.  She indicated that she will seek to pass this item tonight.  Mrs. Malone reported on Item #3 to create Section 301.071 of the Codified Ordinances, on tonight’s Agenda for its first reading.  Mrs. Malone reported on Item #5 to amend Section 353.02 of the Revised Ordinances, on tonight’s Agenda for its first reading. 
 
City Services Committee:
Mrs. Lester reported on Item #4 to direct the Safety-Service Director to advertise for bids and to enter into contracts for annual supplies and maintenance and repair, on tonight’s Agenda for its first reading. 
 
Development Committee:
Mrs. Ames indicated that the Development Committee has nothing on tonight’s Agenda.  However, she stated that the residents on Allen Avenue are requesting a cross-walk at Allen Avenue and Ringwald Streets for school children.  Mayor Sulzer indicated that he will assign a crossing guard at this location. 
 
Safety Service Committee:
Mr. Proehl indicated that the Safety Services Committee also has nothing on tonight’s Agenda.  However, he stated that the committee is requesting that review time be set aside on February 2, 2009, for the purpose of discussing downtown parking, including angle parking on S. Paint Street and metered parking on E. Fourth and W. Fourth Streets as well as S. Paint Street. 
 
Utilities Committee:
Mrs. Patrick provided the annual report of the Chillicothe Nuisance Abatement Board, copies of which were distributed tonight. 
 

  REPORTS OF OFFICIALS

 
Report of Mayor Sulzer:
Mayor Sulzer commented on Item #4, indicating that this is an annual ordinance and that he joins with Mrs. Lester in asking Council to pass it tonight.  He said that this past week, he was visited by officials from the FCC concerning the switch from analog to digital T.V.  He said that he has passed out packets of information to the members of Council on this subject.  Mayor Sulzer said that with the retirement of Chief Keener, he has appointed Captain Tom Hewitt as the interim Chief of Police.  Mayor Sulzer concluded his report by reminding everyone of the events scheduled for Martin Luther King Day, including the march from the Courthouse on January 19, 2009.  He said that the public is invited to attend these events.
 
Report of Law Director Eddy:
Mrs. Eddy gave to Council her annual report on the Law Director’s Office for the year 2008. 
 

  AUDIENCE PARTICIPATION

 
Trisha Fleming of 242 E. Fourth Street
spoke to Council about an incident where her daughter was followed by a man on her way from school.  She said that she has learned that the police are in the middle of a shift change at that time of day.  She requested that Council work with Mayor Sulzer to get a contract change with the F.O.P. to change the shift change away from the school hour change. 
 
Rhonda Jacobs of 800 E. Main Street
spoke against the red light cameras, challenging Councilwoman Malone’s claim that a camera would have stopped a tractor trailer truck from causing the accident at St. Rt. 104 and St. Rt. 32.  She said that there will be a hearing by Redflex tomorrow in the multi-purpose room of the Law Enforcement Complex.
 
Marvin Jones of the Chillicothe Ross Chamber of Commerce
thanked Council for its funding of the zoning law review, and also for everything that the city has done to obtain the downtown grant of over $400,000.00.  He said that these will bring about progress for Chillicothe.  He also thanked Council for scheduling the review session on parking on February 2, 2009. 
 
Pat Phillips of 62 S. Paint Street
spoke in favor of reverting the parking meters to payment enforcement on S. Paint Street. 
 
Kevin Coleman of 496 Infirmary Lane
spoke about tourism, stating that our heritage is our inheritance from the past.  He handed out to the members of Council packets from the Convention Visitors Bureau and spoke about tourism, providing statistics.
 
Bob Evans of 6633 St. Rt. 159
talked about Tecumseh!, and the need to get more attendance this coming year.  He said that he is also in favor of the red light cameras, saying that they have personally made him a safer driver, and they do not involve a criminal offense.  He said that he has heard a lot of other people say that they are also more careful now, and he said that safety is the ultimate concern.  He thanked Council for the courage to install these cameras. 
 
William Loucks of 327 Shannon Drive
spoke to Council in opposition to the red light cameras.  Also, he said that with respect to the lot at Fourth Street and S. Paint Street, the meters are already there. 
 
Mr. William Barnhart of 373 McKeller
spoke to Council stating that he does not want the circulars that are being delivered by the Chillicothe Gazette to his house or to vacant houses.  He said that he is also against the Redflex cameras, and he said that the rest of the roadways not covered by these cameras are dangerous.  He said that drivers using cell phones are dangerous.  He also said that the Carlisle Building should be taken care of.
 
Tom Summers of 6110 Marietta Road
spoke in opposition to the red light cameras. 
 
Keith Richter of 343 E. Water Street
spoke about tourism, saying that if a tourist is cited by Redflex he will not return to Chillicothe.  He said that no jobs are coming into our community as a result of these Redflex cameras.
 
Matt Allen of 69 Applewood Drive
provided details and an update on a new federal program, the National Stabilization Program.  He said that it is to try to stem the rate of foreclosures.
 
Brian Tompkins of 49 Page Road
spoke against the red light cameras, stating that they are not for safety and that they deny citizens of their constitutional rights.
 
William Loucks
again spoke against the red light cameras.
 

OLD BUSINESS

 
Mrs. Patrick said that there have been a lot of breaking and enterings in the Sixth Ward.  She urged the residents to be vigilant and to call the police if they see anything suspicious.
 
Mrs. Lester said that the area of High Street and Church Street have been having the same problems, and that people need to be aware of this and to watch out for each other. 
 
Mrs. Malone said that she has never stated that she voted for the red light cameras to generate money.  She said that she voted for them for safety reasons.  She said that she has personally slowed down in her driving.

Pres. Shoultz said that there will be no meeting next Monday, on Martin Luther King Day.  He reminded everyone that there will be a review session on February 2, 2009, at the request of the Safety Services Committee, to discuss downtown parking.
 

  READING AND PASSAGE OF LEGISLATION

 
Ord. No. 1-09
enacting Section 301.53 entitled “Street Lawn Area” of the Codified Ordinances of the City of Chillicothe, Ohio was read for the third time by title only.  On final passage, all members present voted “yea” and Pres. Shoultz declared Ord. No. 1-09 adopted.
 
Ord. No. 2-09
consenting to the proposal submitted by the Ohio Department of Transportation to upgrade certain traffic signals and to install overhead lane control signs on U. S. 50 west (a.k.a. Western Avenue) within the corporation limit, authorizing the Mayor to enter into contracts to complete said project, and declaring an emergency was read for the second time by title only.  Mrs. Malone moved and Mrs. Patrick seconded that the three reading rule be suspended, placing this item on final passage.  All members present voted “yea” and Pres. Shoultz declared the rule suspended.  All members present voted “yea” on the item itself, and Pres. Shoultz declared that Ord. No. 2-09 adopted.
 
An Ordinance creating Section 301.071 of the Codified Ordinances of the City of Chillicothe, Ohio was read for the first time by title only. 
 
Ord. No. 3-09
authorizing and directing the Safety-Service Director to advertise for bids and enter into contracts for annual supplies and maintenance and repair of the equipment required by the City of Chillicothe, Ohio, and declaring an emergency was read for the first time by title only.  Mrs. Lester moved and Mrs. Malone seconded that the three reading rule be suspended, placing this item on final passage.  All members present voted “yea” and Pres. Shoultz declared the rule suspended.  All members present then voted “yea” on the item itself, and Pres. Shoultz declared Ord. No. 3-09 adopted.
 
An Ordinance amending Section 353.02 of the Revised Ordinances of the City of Chillicothe, Ohio was read for the first time by title only. 
 
Mrs. Henderson moved and Mrs. Lester seconded that the meeting be adjourned.  All members present voted “yea” and Pres. Shoultz declared the motion adopted.  Adjourned at 8:25 p.m.
